Before starting to use a business name you must make sure that no other company is using the name.
You are not allowed to play on similarity of another business name. Your company’s name must be significantly different from that of other businesses. The name must not be subject to likelihood of confusion, e.g. indicating an activity not carried out by the company.
Name Searches If you do not want to spend 2-3,000 Dkr. on having the Danish Patent and Trademark Office carrying out an exhaustive name search for you, you can carry an almost exhaustive search out yourself.
Start to Google your name. You can dial 118 and ask the information service if a similar company name is already in existence. Several on-line name search services are offered on the Internet, e.g. www.degulesider.dk, www.krak.dk, or www.kob.dk, www.cvr.dk
If you can prove that you are the first to use a name you have gained a prescriptive right to that name. Thus, you do not have to actually apply for a formal registration of a name.
Domain Name As soon as you’ve settled for a business name remember to immediately register it as an Internet domain name. You can check out domain name availability on this URL: www.dk-hostmaster.dk
