To a large extent there is freedom of contract in Denmark meaning that you can enter into a binding agreement on anything you want.
However, the Danish Sale of Goods Act, the Danish Salaried Employees Act, the Danish Rent Act, etc., set forth rules which cannot be dispensed with by agreement between the parties.
Oral agreements Oral agreements are as binding as written, though harder to prove. Therefore, it is a good idea to always make agreements in writing.´ And therefore, it is a good idea to always confirm oral agreements in writing to avoid subsequent law suits.
Confirmed agreements If an agreement is to be sent, the best format is by letter or by fax.
Confirmed by e-mail are also legally binding. However, as the possibility of fraud exists it is advisable to print out important e-mails as they are likely to be submitted to the court as evidence.
Liability for damages is a remedy for breach of contract, etc.
